This agreement is made between Side Filo Rent a Car (hereinafter referred to as the "Lessor") on one side and the Lessee (hereinafter referred to as the "Lessee"), whose details are provided within the scope of this agreement, on the other side, under the terms and conditions set forth below.
Subject of the Agreement
The subject of this agreement is to grant the Lessee the right to use the vehicle, owned by the Lessor and specified with its technical features, license plate number, and delivery condition within this agreement, for a specific period in exchange for the rental fee.
Vehicle Delivery and Return Conditions
- The vehicle will be delivered to the Lessee in full working condition at the date, time, and place specified in the agreement.
- The Lessee is obliged to return the vehicle in the same condition as received (except for normal wear and tear) with the same fuel level, tires, spare tire, jack, equipment, and documents.
- Any damage, missing fuel, or missing equipment detected upon return will be charged to the Lessee.
- In case of delays in return, a late fee of 25% of the daily rental price will be applied.
Usage Conditions
- The vehicle may only be driven by the person(s) specified in the agreement.
- The vehicle may not be taken outside the borders of the Republic of Turkey.
- The vehicle may not be used for freight transport, racing, speed testing, towing/pushing, off-road driving, or in any way that endangers traffic safety.
- Smoking in the vehicle is strictly prohibited.
- If pets are to be transported, the Lessor must be informed prior to delivery.
License and Age Requirements
- For economy/standard class vehicles: Minimum 21 years of age and 2 years of driving experience are required.
- For SUV/Premium/Luxury class vehicles: Minimum 25 years of age and 3 years of driving experience are required.
- Foreign customers must present a valid national or international driving license.
Rental Fee and Payment
- The rental fee is calculated based on the duration specified in the agreement.
- An advance payment or credit card pre-authorization may be required for reservation confirmation.
- A deposit will be collected upon vehicle delivery and will be refunded if there is no damage, missing fuel, or penalties (refund may take 3–5 business days).
- Any additional costs such as delays, fuel differences, damages, or traffic fines will be charged to the Lessee.
Insurance and Coverage
- The vehicle is covered by mandatory traffic insurance and comprehensive insurance.
- Situations not covered by insurance include:
- Driving under the influence of alcohol/drugs
- Use of the vehicle by unauthorized persons
- Damages caused by violation of traffic laws
- Off-road, racing, or excessive speed driving
- Additional coverage packages (tire, glass, headlight insurance, etc.) can be provided upon request.
- In case of an accident, a traffic accident report and an alcohol report must be obtained.
Fuel Policy
- A Full to Full policy applies (full tank delivery – full tank return).
- If the vehicle is returned with less fuel, the fuel difference + service fee will be charged.
Traffic and Parking Fines
- All traffic fines, tolls, and bridge crossing fees incurred during the rental period are the responsibility of the Lessee.
- HGS/OGS toll fees will be calculated and charged at the end of the rental period.
Breakdown and Accident Situations
- In the event of a breakdown or accident, the vehicle must not be moved, and the Lessor must be informed immediately.
- In case of an accident:
- Traffic and police reports must be obtained
- An alcohol report must be presented
- The damage must be documented with photographs
- Roadside assistance service is free of charge (in some remote areas, towing fees may apply).
Reservation Cancellation and Changes
- Cancellations must be notified at least 24 hours in advance.
- No refund will be given for late cancellations or no-shows.
- Reservation changes are subject to vehicle availability.
Disclaimer
- The Lessor is not responsible for damages resulting from the Lessee's negligence or fault.
- The Lessor cannot be held responsible for the loss of personal belongings left in the vehicle.
Jurisdiction
- In case of any disputes arising from this agreement, the Antalya Courts and Enforcement Offices shall have jurisdiction.
